Last updated: September 2026

Welcome to KVIMATOV.

These Terms of Service (“Terms”) govern your access to and use of the KVIMATOV website and online store, including all related information, content, features, tools, products and services (collectively, the “Services”).

The terms “we”, “us”, “our” and “KVIMATOV” refer to Robert Vilchynskyi, trading as KVIMATOV.

Our online store is powered by Shopify, which provides the e-commerce platform that enables us to offer the Services to you.

Please read these Terms carefully before using our Services or placing an order.

By accessing, browsing or using our Services, or by purchasing products through our online store, you agree to be bound by these Terms.

If you do not agree with these Terms, you should not use or access our Services.

These Terms apply subject to mandatory consumer protection rights under applicable law. Nothing in these Terms limits any rights that cannot legally be excluded or restricted.

SECTION 1 – ACCESS AND ACCOUNT

To use certain features of our Services, including placing an order, you may be required to provide information such as your name, email address, billing information, payment information and shipping address.

You agree that the information you provide is accurate, complete and up to date.

You are responsible for maintaining the confidentiality of any account credentials associated with your account and for activities carried out through your account.

You must not sell, transfer, assign or otherwise provide your account to another person where this is not permitted by applicable law.

We reserve the right to suspend or terminate an account where there is a reasonable basis to believe that the account is being used fraudulently, unlawfully or in violation of these Terms.

SECTION 2 – OUR PRODUCTS

We make reasonable efforts to ensure that product descriptions, photographs, ingredients, specifications and other product information displayed on our website are accurate and up to date.

However, the actual color, appearance or packaging of a product may differ slightly from how it appears on your screen due to your device, display settings or other technical factors.

Product information, descriptions and images may be updated from time to time where reasonably necessary.

We reserve the right to discontinue products or modify product availability.

Any such changes will not affect orders that have already been accepted, except where required by applicable law.

SECTION 3 – COSMETIC PRODUCTS AND USE

KVIMATOV products are cosmetic and personal care products intended to be used according to the instructions and warnings provided on the product packaging and product page.

Before using a product, you should carefully read the product information, ingredients, directions for use and warnings.

Products should not be used for purposes other than their intended cosmetic purpose.

If irritation, an allergic reaction or other adverse reaction occurs, discontinue use immediately.

If you have known allergies or sensitivities to any ingredients, carefully review the ingredient list before use.

Information provided on our website is for general cosmetic and informational purposes and does not constitute medical advice, diagnosis or treatment.

SECTION 4 – ORDERS

When you place an order through our online store, you submit an offer to purchase the products selected by you.

After submitting an order, you will receive an automated email confirming receipt of your order.

This automated confirmation does not necessarily constitute acceptance of your order.

The purchase contract is concluded when we accept your order by sending you an order confirmation or by dispatching the ordered products.

We reserve the right to refuse or cancel an order for legitimate reasons, including product unavailability, obvious pricing or product information errors, payment problems, suspected fraudulent activity or other circumstances permitted by law.

If we cancel an order after payment has been received, we will refund the amount paid for the cancelled products.

Please review your order carefully before completing your purchase.

Your statutory right of withdrawal and other mandatory consumer rights remain unaffected.

SECTION 5 – PRICES AND BILLING

All prices displayed in our online store are stated in euros (€), unless otherwise indicated.

Prices displayed to consumers are final prices. As a small business according to § 19 UStG, no VAT is charged. Shipping costs, where applicable, are displayed separately before you complete your purchase.

Shipping costs, where applicable, are displayed separately before you complete your purchase.

The total amount payable, including applicable shipping costs, will be shown during checkout before you submit your order.

The price applicable to your order is the price displayed at the time the order is placed.

We reserve the right to change prices at any time. Price changes will not affect orders that have already been accepted.

We may occasionally offer promotions or special offers. Additional terms may apply to such promotions.

You agree to provide accurate and complete payment and billing information.

If your payment information changes, you should update it where necessary so that we can process your order and contact you regarding your purchase.

SECTION 6 – PAYMENT

We offer the payment methods displayed during checkout.

Payment must be successfully authorized or completed before an order is processed, unless another payment arrangement is expressly offered.

Payments may be processed by third-party payment service providers.

Where payment is processed by a third-party payment provider, your payment information may be processed directly by that provider in accordance with its own terms and privacy policy.

SECTION 7 – SHIPPING AND DELIVERY

We deliver to the countries and destinations available during checkout.

Available shipping methods, shipping costs and estimated delivery times are displayed during the checkout process.

Delivery times are estimates unless a specific delivery date has been expressly agreed.

We are not responsible for delays caused by circumstances outside our reasonable control, including carrier disruptions, strikes, severe weather, customs procedures or other events beyond our reasonable control.

However, mandatory statutory consumer rights relating to delivery delays remain unaffected.

For consumers, the risk of accidental loss or damage generally passes in accordance with applicable mandatory consumer protection law.

If an order arrives visibly damaged, we recommend notifying the delivery carrier and contacting us as soon as reasonably possible. Failure to do so does not affect your statutory rights.

SECTION 8 – RETURNS AND RIGHT OF WITHDRAWAL

Consumers in the European Union generally have a statutory right of withdrawal from distance contracts.

The conditions, procedure and applicable exceptions are described in our separate Withdrawal and Returns Policy.

Certain sealed cosmetic products may be excluded from the right of withdrawal after the seal has been removed, where this is permitted under applicable law and the goods are no longer suitable for return for reasons of health protection or hygiene.

Nothing in these Terms limits or excludes any mandatory statutory consumer rights.

For information about withdrawals, returns and refunds, please refer to our separate Returns Policy.

SECTION 9 – INTELLECTUAL PROPERTY AND LICENSED CONTENT

Our Services and their original content, including the KVIMATOV name, logo, original brand identity, original photographs, videos, graphics, texts, designs and other materials created by or for KVIMATOV, may be protected by applicable intellectual property laws.

Some product-related content and materials displayed on our Services, including product descriptions, product images, product information, graphics, mockups, packaging-related materials and other product assets, may be provided to us by our manufacturing, private-label or fulfillment partners and their designated entities or Responsible Persons in the relevant markets. We use such materials in accordance with the applicable terms, licenses and permissions granted to us by the respective provider.

We do not claim ownership of content or materials that are owned by our manufacturing, private-label, fulfillment or other third-party partners. Such materials remain subject to the intellectual property rights and licensing terms of their respective owners.

Certain photographs, videos, fonts, graphics, music and other materials may also be obtained from third-party content providers and used by us under applicable licenses. We do not claim ownership of such third-party materials.

The KVIMATOV name, logo and original brand materials are used by us in connection with our business and may be protected by applicable trademark, copyright and other intellectual property laws. The ™ symbol indicates that we claim rights in the KVIMATOV name or branding as a trademark or trade name. It does not indicate that the trademark has been registered.

You may not reproduce, distribute, modify, publish, commercially exploit or otherwise use our original KVIMATOV content or branding without our prior written permission, except where such use is permitted by applicable law.

Nothing in these Terms grants you any license or other rights to use the KVIMATOV name, logo, original brand materials or other intellectual property owned or controlled by us, except as expressly permitted by us or by applicable law.

Third-party trademarks, product materials, photographs, videos, graphics and other third-party content appearing on our Services remain the property of their respective owners and are used in accordance with applicable rights, licenses or permissions.

SECTION 10 – OPTIONAL THIRD-PARTY TOOLS

We may provide access to certain tools, features or services provided by third parties.

Such third-party tools may be provided independently of KVIMATOV and may be subject to additional terms and conditions of the relevant provider.

Where appropriate, your use of such third-party services is also subject to the provider’s own terms.

We may introduce additional features or tools in the future. Any such features will form part of the Services and will be subject to these Terms unless otherwise stated.

SECTION 11 – THIRD-PARTY LINKS

Our Services may contain links or references to websites, services or resources operated by third parties.

We are not responsible for the content, availability, security or practices of third-party websites or services that are outside our control.

If you access a third-party website or service through a link on our website, you do so at your own risk.

Any transactions or interactions you have with third parties are governed by the terms and policies of those third parties.

SECTION 12 – RELATIONSHIP WITH SHOPIFY

Our online store is powered by Shopify, which provides the e-commerce platform that enables us to offer the Services to you.

However, any purchase or sale of products through our online store is made directly between you and Robert Vilchynskyi, trading as KVIMATOV.

Shopify is not the seller of our products and is not responsible for the products purchased from KVIMATOV.

To the extent permitted by applicable law, Shopify and its affiliates are not responsible for obligations arising from transactions between you and KVIMATOV.

Nothing in this section limits any rights or remedies that you may have under mandatory applicable law.

SECTION 13 – PRIVACY

The collection and processing of personal data through our Services is governed by our separate Privacy Policy.

Our Privacy Policy explains what personal information we collect, how and why we process it, the legal bases for processing, the service providers we use and your rights under applicable data protection law.

Please review our Privacy Policy before using our Services.

SECTION 14 – CUSTOMER FEEDBACK AND REVIEWS

If you voluntarily submit reviews, comments, suggestions, ideas or other feedback to us (“Feedback”), you agree that we may use such Feedback for purposes related to operating, improving and promoting our Services, subject to applicable law.

You retain ownership of your Feedback.

By submitting Feedback, you confirm that:

  1. you have the necessary rights to submit it;
  2. it does not infringe the rights of any third party;
  3. it does not contain unlawful, defamatory, abusive or misleading material; and
  4. it does not contain malicious software or other harmful material.

We reserve the right to remove or refuse to publish Feedback that is unlawful, misleading, offensive, defamatory or otherwise inappropriate.

We do not guarantee that Feedback will remain confidential or that we will publish or respond to every submission.

SECTION 15 – ERRORS, INACCURACIES AND OMISSIONS

There may occasionally be information on our website containing typographical errors, inaccuracies or omissions relating to product descriptions, pricing, promotions, shipping costs, delivery times or availability.

We reserve the right to correct such errors and update information where reasonably necessary.

If an obvious error affects an order, we may contact you and, where legally permitted, cancel the affected order and refund any payment already made.

Nothing in this section limits your statutory rights.

SECTION 16 – PROHIBITED USES

You may use our Services only for lawful purposes.

You must not use the Services:

  • for fraudulent or unlawful purposes;
  • to violate applicable laws or regulations;
  • to infringe intellectual property rights;
  • to transmit malicious software or harmful code;
  • to interfere with the security or operation of our Services;
  • to impersonate another person or entity;
  • to provide false or misleading information;
  • to collect personal information of other users without authorization;
  • to send spam or other unauthorized communications;
  • to scrape, copy or extract substantial portions of our website for unauthorized commercial purposes; or
  • to otherwise misuse our Services.

We may restrict or terminate access where reasonably necessary if you materially violate these Terms or applicable law.

SECTION 17 – AUTOMATED ACCESS AND AGENTS

Automated systems, bots, scraping tools, artificial intelligence agents and other automated software must not access or interact with our Services in a way that violates these Terms, circumvents technical restrictions, interferes with the operation of our Services or extracts website content without authorization.

We may use technical measures to restrict or prevent unauthorized automated access.

This section does not prohibit ordinary use of publicly available website content where such use is permitted by applicable law.

SECTION 18 – TERMINATION

We may restrict or terminate your access to our Services where permitted by applicable law, including where you materially violate these Terms or use the Services unlawfully.

Termination does not affect rights or obligations that arose before termination.

Provisions that by their nature should continue after termination, including intellectual property, liability, governing law and other applicable provisions, will remain effective to the extent permitted by law.

SECTION 19 – DISCLAIMER

The information provided through our Services is intended for general informational and cosmetic purposes.

We make reasonable efforts to ensure that information on our website is accurate and current.

However, we do not guarantee that all information will always be complete, accurate, current or error-free.

Our products are supplied subject to the statutory rights and warranties applicable under German and European law.

Nothing in these Terms excludes or limits mandatory statutory warranties, consumer rights or liability that cannot legally be excluded or limited.

SECTION 20 – LIMITATION OF LIABILITY

Nothing in these Terms excludes or limits our liability where such exclusion or limitation is prohibited by applicable law.

In particular, nothing in these Terms excludes or limits liability for:

  • injury to life, body or health caused by negligence or intentional conduct;
  • damage caused intentionally or through gross negligence;
  • liability under applicable product liability legislation;
  • fraudulent concealment of defects;
  • mandatory statutory consumer rights; or
  • any other liability that cannot legally be excluded or limited.

Subject to the above, our liability shall be limited to the extent permitted by applicable law.

SECTION 21 – INDEMNIFICATION

Where permitted by applicable law, you agree to be responsible for losses or claims arising from your unlawful use of our Services or your material violation of these Terms.

This provision does not apply to the extent that mandatory consumer protection law prevents such an obligation.

Nothing in this section limits any rights you have as a consumer under applicable law.

SECTION 22 – SEVERABILITY

If any provision of these Terms is found to be invalid, unlawful or unenforceable, the remaining provisions will remain in effect to the extent permitted by law.

The invalid or unenforceable provision shall be replaced or interpreted, where legally possible, in a manner that most closely reflects its intended purpose while complying with applicable law.

SECTION 23 – WAIVER; ENTIRE AGREEMENT

If we do not immediately enforce a right or provision of these Terms, this does not constitute a waiver of that right or provision.

These Terms, together with the policies expressly incorporated by reference, constitute the agreement governing your use of our Services and purchases from our online store, subject to mandatory statutory rights.

Any ambiguity in these Terms shall not automatically be interpreted against either party.

SECTION 24 – ASSIGNMENT

You may not transfer or assign your rights or obligations under these Terms where this would be prohibited by applicable law.

We may transfer or assign our rights and obligations where permitted by applicable law, provided that this does not adversely affect your mandatory consumer rights.

SECTION 25 – GOVERNING LAW

These Terms are governed by the laws of the Federal Republic of Germany, subject to mandatory consumer protection provisions applicable in the country in which you have your habitual residence.

If you are a consumer residing in another EU Member State, you continue to benefit from mandatory consumer protection provisions applicable to you under EU law and the law of your country of residence where required.

Nothing in these Terms deprives consumers of mandatory rights that cannot legally be excluded.

SECTION 26 – CONSUMER DISPUTE RESOLUTION

The European Commission’s Online Dispute Resolution (ODR) platform was discontinued on 20 July 2025.

We are not currently obliged to participate in dispute resolution proceedings before a consumer arbitration board unless such participation is required by applicable law or we voluntarily agree to participate.

If you have a complaint or concern, we encourage you to contact us directly first so that we can attempt to resolve the matter.

SECTION 27 – CHANGES TO THESE TERMS

You can review the most current version of these Terms at any time on this page.

We reserve the right to update or modify these Terms where reasonably necessary, including to reflect changes to our Services, products, legal requirements or business operations.

The latest version will always be published on this page together with the applicable “Last updated” date.

Changes will not affect orders that have already been accepted, except where required by applicable law.

Where legally required, we will provide notice of material changes.
